ELLSWORTH COUNTY COMMISSIONER MEETING
MINUTES
AUGUST 30, 2010
The Board of Ellsworth County Commissioners convened this 30th day of August 2010 at the Ellsworth County Courthouse.
Members Present:
Albert W. Oller, 1st District Commissioner
Kermit Rush, 2nd District Commissioner
Terry L. Kueser, 3rd District Commissioner
OPENING BUSINESS:
Chairman Rush called the meeting to order at 9:00 a.m.
Commissioner Kueser moved to approve the Agenda with an addition. Commissioner Oller seconded the motion. Motion carried 3-0.
Commissioner Kueser moved to approve the Minutes of August 23, 2010. Commissioner Oller seconded the motion. Motion carried 3-0.
No one was present for the Public Forum.
APPOINTMENTS:
At 9:05 a.m. Chairman Rush called to order the hearing for the closing of a road in Langley Township. Those is attendance were: Landowners Gail Lindstedt (also Trustee of Langley Township), Matt Hedburg, and Herb Soukup; Property renters, Andrew Soukup and Steve Soukup; other interested parties, Cynthia J. Alexander, Vera Rush and Suzan Fitzsimmons and County Attorney, Joe Shepack. Mrs. Rush and Fitzsimmons presented their reasons why the road should not be closed as it was a road used by Mrs. Rush to check cattle and to close it would a hardship on her and affect her income. The landowners showed pictures of the road showing it had never been maintained as a road was overgrown with large trees. Commissioner Kueser moved to vacate the following road in Langley Township:
A north-south road with its northern terminus at the intersection of
Avenue X and 29th Road and proceeding south for one (l) mile on the
Section line between Section 34 and Section 35 to the Ellsworth County-
Rice County line in Langley Township (which is Township 17 South and
Range 6 West).
Commissioner Oller seconded the motion. Motion carried 3-0. Mr. Hedburg expressed a desire to work with Mrs. Rush, if possible, to use the property.
At 10:00 a.m. Chairman Rush called to order the hearing for closure of a road in Ask Creek Township. Those in attendance were Kendall Rathbun, Ash Creek Treasurer and Lloyd Prochaska, Ash Creek Clerk. Commissioner Kueser moved to vacate the following road in Ash Creek Township:
A one (1) mile east-west roadway commencing at the intersection of Avenue P
And Kansas Highway 14 and proceeding west for one (1) mile on the section
Line between Section 16 and Section 21 in Ash Creek Township (which is
Township 16 South and Range 8 West).
Commissioner Rush seconded the motion. Motion carried 3-0.
Commissioner Kueser moved to go into executive session to discuss non-elected personnel with Roberta Waymaster, Technology Committee, from 10:27 a.m. to 10:40 a.m. Commissioner Oller seconded the motion. Motion carried 3-0. County Clerk, Jan Andrews, was included in the executive session. The Commissioners returned to open session at 10:40 a.m. and no action was taken.
Carl Miller, Appraiser, presented the 2011 State Maintenance Report for their signature. The Commissioners signed the document. Mr. Miller asked to purchase a new computer for himself and presented two bids. One bid did not include labor for setup and bid a smaller computer. The Commissioners suggested he contact that company and ask that they include labor and the upgraded size of computer. Commission Kueser moved to approve the purchase of a computer in the $1,800 range to be taken from the Equipment Reserve Fund. Commissioner Oller seconded the motion. Motion carried 3-0.
OLD BUSINESS:
There were no old business items.
NEW BUSINESS:
Commissioner Kueser moved to approve the August payroll in the amount of $182,640.50. Commissioner Oller seconded the motion. Motion carried 3-0.
ADJOURNMENT:
Chairman Rush adjourned the meeting at 12:05 p.m.
